Edinburgh, 1 February 2006. The Tribunal having considered the Complaint dated 13 July 2005, at the instance of the Council of the Law Society of Scotland against John Atuahene, Solicitor, 72 Hawkshead Road, Paisley and Richard Thomas Thorburn, Solicitor, Thornhome House, By Carluke, Dismiss the Second Respondent’s preliminary pleas of ultra vires, oppression and relevancy and adjourned the Hearing of the Complaint to such future date as may be fixed; Direct that the issue of expenses be reserved until the conclusion of the matter and Direct that publicity be given to this Decision but that such publicity be deferred until a date to be agreed by the Tribunal.
