For Complaints:
The Law Society will submit a Complaint to the Tribunal alleging that a solicitor may be guilty of professional misconduct.
For Section 42ZA(9) “Appeals by Solicitors in respect of a finding of unsatisfactory professional conduct made by the Law Society”
For Section 42ZA(10) “Appeals by Lay Complainers in respect of the Law Society’s failure to make a finding of unsatisfactory professional conduct against a Solicitor”
For Section 42ZA(11) “Appeals by Lay Complainers against a Law Society failure to make an award of compensation in respect of a finding of unsatisfactory professional conduct against a Solicitor”
For Section 42ZA(12) “Appeals by Lay Complainers about the amount of compensation awarded by the Law Society in respect of a finding of unsatisfactory professional conduct against a Solicitor”
Guidance notes are available on the website in respect of the making of Section 42ZA Appeals.
For Section 53(1)(b):
If a solicitor has been convicted by any court of any act involving dishonesty or has been fined an amount equivalent to Level 4 or sentenced to imprisonment for a term of 12 months or more, the Tribunal has jurisdiction in terms of Section 53(1)(b) and there is no requirement to make a finding of professional misconduct.
