By Video Conference, 7 September 2020. The Tribunal having considered the Complaint at the instance of the Council of the Law Society of Scotland against Eric Robert Lumsden, Sneddon Morrison, Clydesdale Bank Chambers, 16 East Main Street, Whitburn; Find the Respondent guilty of professional misconduct in that (a) he failed to advise his client he had been requested to give and had given undertakings to make two payments from her ledger totalling more than £70,000 to two third parties and (b) he failed to make a required disclosure in terms of Section 330 of the Proceeds of Crime Act 2002 and failed to advise the purchaser’s Scottish solicitor regarding the contact with their client or make enquiries of the purchaser’s Scottish solicitor regarding the source of their client’s deposit; Censure the Respondent; Fine him in the sum of £1,000 to be forfeit to Her Majesty; Find the Respondent liable in the expenses of the Complainers and of the Tribunal including expenses of the Clerk, chargeable on a time and line basis as the same may be taxed by the Auditor of the Court of Session on an agent and client, client paying basis in terms of Chapter Three of the last published Law Society’s Table of Fees for general business with a unit rate of £14.00; and Direct that publicity will be given to this decision and that this publicity should include the name of the Respondent but need not identify any other person.
